These Terms of Service ("Terms") govern your use of the ByteBarker LLC public website at www.bytebarker.com, including the contact form, the booking system, and any informational content published here.

Paid consulting engagements are governed by separate written agreements (Master Services Agreements and Statements of Work), not by these Terms. Where the two conflict, the signed agreement controls for that engagement.

By accessing the site, submitting an inquiry, or booking a meeting, you agree to these Terms. If you do not agree, do not use the site.

You agree not to:

• • Use the site for any unlawful purpose or to violate any applicable law.
• • Attempt to gain unauthorized access to any part of the site, related infrastructure, or other users' accounts.
• • Probe, scan, or test the vulnerability of the site or breach security or authentication measures, except through coordinated disclosure (see Security below).
• • Interfere with the site's operation, including via denial-of-service attacks, excessive automated requests, or any conduct that disrupts service for other users.
• • Submit content that is unlawful, defamatory, infringing, or knowingly false.
• • Scrape or harvest the site's content for republication, training third-party language models, or competitive intelligence without prior written consent.

The site's content — articles, written analysis, source-visible structural code, visual design, and the ByteBarker name and marks — is owned by ByteBarker LLC or its licensors. You may read, link to, and reasonably quote our content with attribution. You may not reproduce substantial portions for commercial purposes without written permission.

Submitting a booking or inquiry creates a contact record so we can respond. It does not create a binding consulting relationship. We will follow up by email or at the scheduled time. We may decline any inquiry or cancel any booking at our discretion (typically: scope mismatch, capacity, conflict of interest).

The site and its content are provided "as is" and "as available." To the maximum extent permitted by law, ByteBarker disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy. The technical guidance published in the Insights section is general in nature and is not a substitute for professional advice specific to your systems.

To the maximum extent permitted by law, ByteBarker is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or in connection with your use of the site. Our total liability for any claims arising from your use of the site is limited to one hundred U.S. dollars (USD $100). This limitation does not apply to liability that cannot be excluded under applicable law.

Liability under signed consulting agreements is governed by the limitation provisions in those agreements, not by this section.

You agree to indemnify and hold harmless ByteBarker LLC, its officers, employees, and contractors, against any claims, damages, or expenses arising from your breach of these Terms or your unlawful use of the site.

If you discover a vulnerability in the site, please report it responsibly to [email protected] with enough detail to reproduce. We will acknowledge in good faith and work to remediate. Do not exploit the issue beyond what's needed to demonstrate it, and do not access data that isn't yours.

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the site shall be brought exclusively in the state or federal courts located in Fairfax County, Virginia, and you consent to the personal jurisdiction of those courts.

We may update these Terms from time to time. Material changes will be noted by updating the effective date above and, where appropriate, by a notice on the site. Your continued use of the site after changes are posted constitutes acceptance of the updated Terms.
